By using the website, creating an account, or purchasing a product, you agree to these Terms and the Privacy Policy.
1. Eligibility and Acceptance
You must be at least 18 years old and legally able to enter a contract, or use the website with the involvement and permission of a parent or legal guardian. If you use Yahmiir.com for a business or organization, you represent that you have authority to bind it to these Terms.
2. Products, Prices, and Checkout
Product descriptions, availability, previews, prices, and promotions may change before purchase.
Applicable taxes, shipping charges, and disclosed transaction fees are added during checkout.
Stripe processes payments. A purchase is not complete until payment is successfully confirmed.
We may refuse, cancel, limit, or refund an order affected by suspected fraud, an obvious pricing or product error, unlawful activity, unavailable inventory, or a technical problem.
You are responsible for providing accurate email, billing, shipping, and contact information.
3. Digital Downloads and License
A completed digital purchase grants the purchaser a limited, personal, nonexclusive, nontransferable, revocable license to download and use the purchased file for lawful personal use. A purchase does not transfer copyright, publishing rights, master rights, trademark rights, resale rights, or ownership of the music or artwork.
You may not resell, redistribute, publicly upload, share download links, make files available through peer-to-peer services, remove rights information, bypass access controls, or use purchased content commercially without separate written permission.
Keep a lawful backup after downloading. Download links and server storage are not guaranteed to remain available indefinitely. When a paid file is unavailable or a verified customer experiences a technical delivery error, contact support with the Stripe receipt so we can reasonably attempt to restore access or provide an appropriate remedy.
4. Refunds
Digital music and downloadable product sales are generally final after access is delivered because digital products cannot be returned. This policy does not limit rights that cannot legally be waived. Yahmiir.com may provide a replacement download or refund when a verified purchase cannot be delivered, is materially different from its description, was duplicated because of a confirmed technical error, or when another remedy is required by applicable law. Shipped-product refunds, if offered, may be subject to separate product-specific conditions.
5. Previews and Availability
Music previews are provided for evaluation and may be limited in duration. Preview quality can vary by browser, device, connection, vehicle system, or source media. We may add, update, suspend, or remove products, previews, community features, or website functions.
6. Accounts and Security
You must provide accurate account information, protect your password, and promptly report suspected unauthorized access. You are responsible for activity under your account unless prohibited by law. We may suspend or restrict an account to protect the website, investigate misuse, comply with law, or enforce these Terms.
Contractor accounts and referral activity are also governed by the separately accepted Yahmiir.com Referral Marketing Contractor Agreement. If that agreement conflicts with these Terms on contractor-specific matters, the signed contractor agreement controls.
7. Comments, Chat, Ratings, and Other Submissions
You retain ownership of content you submit. By submitting content for display through Yahmiir.com, you give Yahmiir.com a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and moderate that content for operating and promoting the website.
Do not submit unlawful, infringing, deceptive, abusive, harassing, threatening, hateful, sexually exploitative, private, malicious, or spam content. Do not post personal information about another person without permission. We may remove or restrict content, but we are not required to monitor every submission.
8. Prohibited Conduct
You may not interfere with the website, attempt unauthorized access, scrape or copy protected content, introduce harmful code, abuse downloads, commit fraud, evade payment, manipulate referral attribution, impersonate another person, misuse another account, or use Yahmiir.com in violation of law or third-party rights.
9. Intellectual Property
The website, music, artwork, branding, text, graphics, software, and other content are owned by Yahmiir.com or its licensors and are protected by applicable intellectual-property laws. Except for the limited download license stated above, no rights are granted without written permission.
10. Third-Party Services and Links
Yahmiir.com uses third-party services such as Stripe and GoDaddy and may link to other websites. Third-party services operate under their own terms and privacy policies. Yahmiir.com is not responsible for third-party content, availability, security, or independent practices, except to the extent required by law.
11. Disclaimers
To the extent permitted by law, the website and its content are provided "as is" and "as available." We do not guarantee uninterrupted operation, compatibility with every device, permanent availability, particular sales or promotional results, or that every error will be corrected. These disclaimers do not exclude warranties or rights that cannot lawfully be excluded.
12. Limitation of Liability
To the extent permitted by law, Yahmiir.com and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or business interruption arising from use of the website. For a claim involving a paid product, aggregate direct liability will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law.
13. Indemnification
To the extent permitted by law, you agree to defend and indemnify Yahmiir.com and its owner from claims, losses, and reasonable costs arising from your unlawful conduct, infringement, misuse of the website, submitted content, or material violation of these Terms.
14. Governing Law and Disputes
Missouri law governs these Terms without regard to conflict-of-law rules. Any dispute that cannot be resolved informally may be brought in a state or federal court with lawful jurisdiction in Missouri, unless applicable consumer law requires another location or procedure. Before filing a claim, contact support and allow a reasonable opportunity to resolve the issue.
15. Changes and General Terms
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless law permits otherwise. If one provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, product-specific terms, and any signed contractor agreement form the applicable agreement between the parties.
